I can help you come to grips with the financial problems of your business or government, and solve them through a reasonable restructuring deal or a prompt trial. During 40 years practicing law with Sidley & Austin, Weil Gotshal & Manges, and Fulbright & Jaworski, I worked with some smart people restructuring billions of dollars of debt. Over 250,000 people have jobs in companies and governments whose debt I helped to restructure.
I learned how to restructure the finances of businesses, cities, states, and countries, including how they can obtain new capital in connection with their financial restructuring.
First, analyze debt structure and cash flow to understand the severity of the insolvency and the value available to support restructuring. Then, figure out the core business or government service you are trying to preserve, determine how much cost-cutting can be imposed, how much revenue and new capital can be raised, and what cash flow is left to pay debts in the order of legal priority.
Armed with this, you can create a fair and equitable restructuring plan and make a deal based on it with your major creditors, or pursue a prompt court case to force that plan on those who refuse to make a reasonable deal.
Some of the work I have done over the years is described below. Much of what I have learned is contained in the papers and published articles available for free download on my website. They include these three papers describing how to deal with insolvency:
- Overview of a Financial Restructure (for fiduciaries of an insolvent business),
- Providing Capital to a Chapter 11 Company (for people wishing to invest in a going concern whose finances need to be reorganized), and
- Leading a Government to Solvency (for government leaders who want to take on and overcome insolvency).
Click here to read the papers mentioned above and many more. I would be happy to discuss how to use any of these papers or published articles.
