SDTX Complex Case Procedures C 1-10 and O 38-40 establish procedures for efficient due process that permit a debtor to confirm a plan of reorganization in 90 to 120 days, even with trials about (i) adequate protection to obtain financing during its case, (ii) whether a proposed sale is fair, and (iii) whether its plan of reorganization is fair and equitable.
Complex Cases filed in the Southern District of Texas will be assigned 50% to Judge Jones and 50% to Judge Lopez. Each has substantial experience with trials concerning cash collateral use, DIP loans, sales, and plan confirmation.
